Samar’s Delights — Store Policies Version 2026-10-14.1 | Updated October 14, 2026 Terms of Service The details that apply when you shop with SAMARS DELIGHTS LLC, operating as Samar’s Delights. “Samar’s Delights,” “we,” and “us” refer to SAMARS DELIGHTS LLC. Shopping with us These terms govern purchases from the Samar’s Delights website. Our Refunds & Cancellations policy is part of these terms. Our Privacy Policy explains how we handle personal information. Please review these policies before continuing to payment. You must be legally able to make a purchase and authorized to use your payment method. Provide accurate order, contact, and delivery details. If you spot a mistake, contact us as soon as possible at samarsdelights@gmail.com. Orders, prices & payment Prices are in U.S. dollars. Review your products, quantities, flavor selections, fulfillment method, and the total shown before completing payment. Shipping and any applicable taxes or other charges are disclosed before the final payment step. Payment is handled through Stripe. An order is not paid simply because you open or leave the payment page. Keep your order confirmation for your records. If an item becomes unavailable or we cannot fulfill your order, we will contact you and provide any refund required by law. We will not charge a higher price or substitute a materially different product without your agreement. Prices and availability may change for future orders. An update to the website does not change the agreed price of an order you have already placed. Handmade products & ingredients Our baked goods are handmade. Appearance, color, shape, and decoration can vary from the photographs. Product descriptions and the choices confirmed with your order describe what you are buying. Review each selected product’s ingredient and allergen information before ordering, including each flavor in an assortment. Contact us before purchase if you have an allergy or dietary question; an order note alone does not confirm that we can accommodate it. Do not assume that an item is free of an allergen unless we have expressly confirmed the relevant information. Shipping & local pickup Current shipping fees, eligibility, dispatch information, and pickup instructions appear on our Shipping & Pickup page and during checkout. Products marked pickup only cannot be shipped. For pickup orders, wait for our ready message and confirmed collection details before visiting. Carrier transit times are estimates unless we expressly agree otherwise. Enter a complete, accurate address and arrange prompt collection and appropriate storage of perishable goods. Tell us promptly about a missing, damaged, incorrect, or delayed order so we can review it. If we cannot ship within the timeframe we promised, we will give the delay notice, cancellation option, and refund required by applicable law. If we cannot fulfill an order, we will refund the unfulfilled portion as required, without a cancellation fee. We do not treat carrier involvement as a waiver of your legal rights. Returns, problems & cancellations Baked goods are final sale and cannot be returned. Customer-requested cancellations we accept carry a 10% fee on the canceled products’ price after discounts, excluding tax and shipping. Refunds required by law are unaffected. If something is wrong with your order, email us with your order number, a description, and helpful photos of the product and packaging. We review concerns individually and work with customers toward an appropriate solution. The full Refunds & Cancellations policy explains the process and exceptions. Accounts & responsible use An account is optional for shopping. Keep your account credentials secure and contact us if you suspect unauthorized access. Do not use the site for fraud, attempt to access another person’s information, or interfere with the store’s operation. Website content, photographs, and branding belong to Samar’s Delights or their respective owners. You may use the site for personal shopping; other use of protected content requires permission or another lawful basis. Service Disclaimers and Limitations of Liability The website and its online features are offered on an “as available” basis. We do not guarantee continuous availability, error-free operation, or compatibility with every device. To the fullest extent permitted by applicable law, Samar’s Delights and its owners, employees, and authorized agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost opportunities, or loss of data, arising from the website, products, orders, or related services. Subject to the exceptions below, our combined liability for a claim or related series of claims will not exceed the greater of $100 or the amount paid for the products giving rise to the claim. These limitations apply regardless of whether a claim is based on contract, ordinary negligence, or another legal theory, and even if the possibility of the loss was foreseeable. We do not guarantee the performance of independent hosting companies, payment processors, email providers, or carriers. Their involvement does not, however, remove any responsibility the law places on us. These limitations do not apply to fraud, intentional misconduct, gross negligence, death or personal injury caused by our acts or omissions, or liability, statutory remedies, product warranties, refunds, or other rights that cannot lawfully be excluded or limited. Binding Individual Arbitration and Class-Action Waiver PLEASE READ CAREFULLY. EXCEPT AS DESCRIBED BELOW, YOU AND SAMAR’S DELIGHTS AGREE TO RESOLVE COVERED DISPUTES THROUGH INDIVIDUAL ARBITRATION, NOT A COURT TRIAL. THIS INCLUDES A WAIVER OF A JURY TRIAL AND PARTICIPATION IN CLASS ACTIONS FOR COVERED DISPUTES. Covered disputes. This agreement applies mutually to disputes arising from or relating to your use of our website, purchases, products, payments, delivery, pickup, customer communications, privacy, data security, or these Terms. It covers claims against our owners, employees, and agents when acting for Samar’s Delights. It applies to conduct occurring after you accept this agreement. Informal resolution. Before beginning arbitration, the party raising the dispute must send a written notice identifying the issue, relevant order information, and requested resolution. Notices to us should be emailed to samarsdelights@gmail.com, with “Notice of Dispute” in the subject. We will send notices to your provided contact address. Both parties will have 30 days to attempt resolution. Applicable filing deadlines will be paused during this period to the extent legally permitted; neither party must miss a deadline to preserve a claim. Arbitration process. Unresolved covered disputes will be administered by the American Arbitration Association (“AAA”) before one neutral arbitrator under its applicable Consumer Arbitration Rules. Rules and filing instructions are available at adr.org. The Federal Arbitration Act governs this arbitration agreement. Proceedings may occur through documents, telephone, or video as permitted by the rules. Any necessary in-person hearing will take place at a reasonably convenient location consistent with AAA requirements. Costs will be allocated under the applicable consumer rules and law, and we will pay the charges assigned to the business. The arbitrator may award remedies available under applicable law, including statutory remedies and attorney’s fees where authorized. The award may be enforced in a court with jurisdiction. Individual proceedings. To the extent legally permitted, neither party may pursue covered disputes as a class or representative action, and the arbitrator may not conduct class arbitration. This provision does not eliminate relief or rights that applicable law makes nonwaivable. Exceptions. Either party may bring an eligible individual claim in small-claims court. Nothing prevents complaints to government agencies, cooperation with regulators, legally protected public-injunction requests, or claims that the law prohibits requiring a consumer to arbitrate. Either party may request temporary court relief needed to preserve rights while arbitration proceeds. 30-day opt-out. You may reject this arbitration agreement by emailing samarsdelights@gmail.com within 30 days after first accepting it. Include your name, the email associated with your order or account, and a statement that you opt out of arbitration. Opting out does not affect your ability to shop with us, and neither party will then be bound by this arbitration agreement. A valid prior arbitration opt-out remains effective. Accepting updated store policies or placing another order does not revoke that opt-out. Enforceability and changes. A court will decide whether this arbitration agreement was formed and whether its class-action waiver is enforceable. If the waiver cannot be enforced for a particular claim or remedy, that portion will proceed in court rather than class arbitration. Other severable provisions remain effective. If AAA declines administration because we fail to comply with its consumer requirements, you may pursue the dispute in a court with jurisdiction. Material changes to this arbitration agreement require notice and affirmative acceptance and will not apply retroactively to an existing dispute. This agreement survives account closure. Applicable law. Ohio law governs these Terms, subject to the Federal Arbitration Act and any mandatory protections applicable to the consumer. AAA Consumer Arbitration Rules, forms & fees: https://www.adr.org/rules-forms-and-fees/consumer/ Email an arbitration opt-out: mailto:samarsdelights@gmail.com?subject=Arbitration%20opt-out Email a notice of dispute: mailto:samarsdelights@gmail.com?subject=Notice%20of%20Dispute Fraud Prevention, Order Review, and Pricing Errors We may decline a proposed order, or lawfully pause or cancel an unfulfilled order, when we reasonably identify unauthorized payment activity, fraud, deliberate misuse of a promotion, a material technical or pricing error, product unavailability, or a security threat. We may request reasonable information needed to resolve the issue. If we cancel an order, we will notify you and promptly return the amounts owed for the canceled portion, including applicable tax and shipping as required, without a customer cancellation fee. We will not impose a higher price, charge an additional amount, or make a material substitution without your agreement. A good-faith complaint, honest review, lawful payment dispute, or exercise of a consumer right is not fraud or promotional misuse. Events Outside Our Reasonable Control To the extent permitted by law, we are not responsible for a delay or failure caused by an event outside our reasonable control, such as severe weather, fire, a carrier-network shutdown, a government restriction, or a widespread utility outage, where reasonable precautions and mitigation would not have avoided the affected performance. We will take reasonable steps to address the disruption and communicate material changes affecting your order. This provision does not authorize indefinite delays or allow us to retain payment for goods we cannot supply. Required shipment-delay notices, cancellation options, and refunds remain available. It does not excuse our own failure to meet a legal duty. Responsibility for Deliberate Misuse To the extent permitted by law, you agree to indemnify Samar’s Delights and its owners, employees, and authorized agents for actual losses and reasonable defense expenses, including reasonable attorney’s fees, arising from third-party claims to the extent caused by your fraud, deliberate unlawful misuse of the website, or content you knowingly submit in violation of another person’s rights. This obligation does not cover losses attributable to our acts or omissions, breach of duty, product defects, or information-security failures. It does not apply merely because you submit a complaint, request a refund, dispute a payment in good faith, post an honest review, or pursue a legal claim against us. We will provide reasonably prompt notice of a covered third-party claim and a reasonable opportunity for you to participate in its defense. We will not agree to a settlement that requires an admission, payment, or other obligation from you without your written consent, which must not be unreasonably withheld. Goodwill Accommodations and No Waiver A voluntary replacement, credit, refund, fee waiver, or other goodwill accommodation is limited to the specific order and issue for which we provide it, unless we expressly agree otherwise in writing. It is not, by itself, an admission of liability, a permanent change to our policies, or a promise to provide the same accommodation in another case. A decision not to enforce a particular provision on one occasion does not, by itself, prevent its lawful enforcement later. Nothing in this section limits an agreed settlement, a binding promise, or a remedy required by law. Relationship to Existing Policies and Severability These supplemental provisions form part of the Terms of Service and, where indicated, the Privacy Policy once properly adopted. They do not replace the Refunds & Cancellations policy or change an already accepted order’s agreed price, products, or fulfillment commitments. Specific order commitments and legally required rights remain controlling. The arbitration section’s particular rules govern arbitration, including its exceptions and treatment of an unenforceable class-action waiver. Except as that section provides, if a provision is held unenforceable, the remaining provisions will continue to apply to the extent they can operate independently and lawfully. This does not authorize rewriting the agreement to eliminate a consumer’s mandatory rights. Changes apply prospectively with any legally required notice or consent. Merely posting an update does not impose new arbitration obligations on prior orders or existing disputes. Your rights & policy updates Nothing in these terms or our other policies excludes rights or remedies that cannot lawfully be limited, including rights relating to incorrect, defective, or unfulfilled orders. No policy requires you to accept store credit instead of a refund to which you are legally entitled. We may update these terms for future use and orders by posting a new version and date. The version accepted with your order remains the version applicable to that order. Material changes to arbitration require notice and affirmative acceptance; posting an update does not bind earlier orders or existing disputes. Questions about these terms can be sent to samarsdelights@gmail.com. Refunds & cancellations Baked with care by SAMARS DELIGHTS LLC, operating as Samar’s Delights. If something isn’t right, please tell us. Perishable goods are final sale Because our products are perishable baked goods, we do not accept returns or offer discretionary refunds on completed orders. Please review your items, flavors, quantities, ingredients, and delivery details before paying. Accepted cancellations and refunds required by law are explained below. A problem with your order? Email samarsdelights@gmail.com as soon as you notice an issue. Include your order number, what happened, and clear photos of the affected product and packaging. For shipping damage, a photo of the shipping label can also help. If photos are unavailable, explain what happened so we can still review your concern. Please do not send food back. Keep any relevant packaging and follow safe food handling practices. Do not eat anything you believe may be unsafe. We review each concern individually and will work with you toward an appropriate solution, which may include a replacement, credit, or another resolution depending on the circumstances. Contacting us does not automatically guarantee a refund or replacement. Requests and documentation requirements do not limit any remedy you are entitled to by law. Order details, collection & storage We do not ordinarily provide discretionary refunds for a change of mind, personal taste preferences, customer-selected items or flavors, an incorrect address supplied by the customer, missed pickup or collection, or damage caused by improper handling or storage after receipt. Delivery or quality concerns are still reviewed on their facts. This policy does not excuse an error by Samar’s Delights or remove rights that applicable law gives you. Customer-requested cancellations: 10% fee To request a cancellation, email samarsdelights@gmail.com with your order number as soon as possible. We will confirm whether the order can still be canceled. A request is not a confirmed cancellation until we acknowledge it in writing. Every customer-requested cancellation that we accept is subject to a fee of 10% of the amount paid for the canceled products, after discounts. Tax and shipping are excluded from the fee calculation. For example, canceling $100 of products carries a $10 fee, even if the original order also included shipping. For an accepted cancellation, the amount paid for the canceled products is returned less this fee. Unused shipping charges and applicable tax are returned or adjusted as appropriate. We will confirm the canceled items, fee, and refund amount with you. Any monetary refund is returned to the original payment method, subject to processing time by the payment provider. Leaving Stripe checkout or closing the browser before payment does not place a paid order and does not incur a cancellation fee. When the fee does not apply We do not charge the cancellation fee when Samar’s Delights cancels because we cannot fulfill the order, or when a refund without that deduction is required by law. Any required refund will include the amounts the law requires, and we will not replace it with mandatory store credit. This policy preserves your applicable consumer rights, including rights relating to defective, incorrect, or unfulfilled orders. If a provision conflicts with a mandatory legal requirement, that requirement controls. Privacy Policy How SAMARS DELIGHTS LLC, operating as Samar’s Delights, handles information when you browse, order, or get in touch. Information we handle We collect information you provide to run the store and serve your order. This includes: - Order and delivery information: your name, email, phone number, shipping address when needed, items, flavor selections, quantities, fulfillment choice, and order notes. - Order records: prices, payment status, payment and order identifiers, fulfillment updates, and the policy version and acknowledgement time associated with checkout. Opening checkout can create an order record even if payment is not completed. - Account information: email, sign-in and verification information, optional email preferences, and any store-policy version and acceptance time you affirmatively submit. Our authentication provider handles account credentials. If an external sign-in option is offered and you use it, information it provides is governed by the permissions you grant. - Communications: messages, photos, and other information you choose to send about an order or question. Send only what is needed; do not email card details or passwords. - Technical information: our hosting, security, payment, and other service providers may process IP addresses, browser or device information, request logs, and session information to operate and protect their services. How we use information We use information to process and fulfill orders, coordinate shipping or pickup, send order updates, provide customer service, maintain accounts, prevent misuse, troubleshoot the store, and keep business records. We also use it when necessary to meet legal obligations or handle disputes. If you choose optional marketing updates, we use your contact information and preference for those updates. Marketing permission is separate from accepting our purchase policies. Changing a marketing preference does not stop necessary messages about an order or your account. Service providers & disclosures Information is shared as needed with providers that support the store, including: - Stripe for hosted checkout and payment processing. Payment details are entered with Stripe; this storefront does not receive or store full card numbers or card security codes. - Google Firebase for customer accounts, authentication, email verification, and password reset messages. - Supabase retains previously stored account and email-preference records during our transition to Firebase. - OpenAI Sites and Cloudflare for website hosting, application data, email preferences, and storage. - Resend and our business email services for order and customer-service communications. - Shipping carriers and authorized people helping us prepare, deliver, and support orders. - Other recipients when disclosure is required by law or reasonably necessary to protect rights, prevent fraud, or respond to a legal process. Each provider may also process information under its own applicable terms and privacy policy. Technology Providers, OpenAI, and Information Security We rely on outside technology companies to operate our store. These include OpenAI Sites and Cloudflare for hosting and related infrastructure, Firebase for account services, Stripe for payment processing, and Resend for email delivery. Depending on the service involved, these providers may process customer contact details, order information, delivery instructions, account-related information, customer communications, and technical information such as IP addresses and request logs. When we use OpenAI tools for store administration, troubleshooting, or customer support, relevant information may also be processed through those tools. We use access restrictions and safeguards supplied by our technology providers to help protect information. These measures reduce risk but cannot eliminate it. We do not promise that information will always remain secure or that unauthorized access, data loss, service interruptions, or other security incidents will never occur. Please provide only information necessary for your purchase or request. Do not include passwords or payment-card details in order notes or support messages. We will respond to security incidents and provide notices as applicable law requires. Nothing in this policy waives legally required privacy protections or breach-notification obligations. Cookies & browser storage The site uses browser storage to remember your bag, checkout details during a session, and sign-in state. Payment, authentication, and hosting services may also use cookies or similar technologies for their services and security. Clearing or blocking this storage can remove saved details, sign you out, or affect checkout. The current storefront is not configured with advertising pixels or cross-site advertising integrations. We do not use it to sell personal information. We will update this policy if the store’s practices change. Keeping & protecting information Retention depends on the type of information and why it is needed. Order, payment, and related communications may need to be kept for fulfillment, accounting, disputes, fraud prevention, and legal obligations. Closing an account or withdrawing marketing permission does not automatically erase records we still need for those purposes. We use access controls and service-provider safeguards to help protect information. No online service can promise absolute security. Providers may process information in the United States or other locations where they operate. Your choices & requests You can shop without creating an account. If you have an account, you can manage optional email updates in your account preferences. You may also email samarsdelights@gmail.com to ask about your information, correct details, request access or deletion, or withdraw a marketing preference. Depending on where you live and which laws apply, you may have additional rights over your personal information. We may need to verify your identity before acting and may retain information where permitted or required. If we cannot fulfill a request, we will explain the reason and any available next steps. Please do not send unnecessary sensitive documents with an initial request. Children This store is intended for purchases by adults or with a parent or guardian’s involvement. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information, contact us so we can review and address it. Questions & updates Contact Samar’s Delights at samarsdelights@gmail.com with privacy questions or requests. Updates will be posted here with a revised date, and we will provide any additional notice or choice required by applicable law.
